Lawyers to Meet with
Coal-Dust Complainants
Lawyers from Vancouver
will be in Kamloops later this month to discuss the progress of a class-action suit
filed against the country's two national railways.
The suit is for alleged damage to property caused by coal dust emissions from passing trains. It also
seeks a long-term remedy. "I think we have enough of a critical mass of concerned
residents," said Jim Vilvang, a lawyer with Richards Buell Sutton, who will be in Kamloops
23 Jun 2004 and 24 Jun 2004.
He's still waiting for a court hearing to have the lawsuit designated as a class-action
proceeding. Filed in B.C. Supreme Court in Vancouver in March, the statement of claim lists Dallas
resident Kathy Roberts as the sole plaintiff. But she is intended to be representative of others who
have allegedly suffered harm as a result of the passing coal cars.
Since filing the claim, and forwarding information to communities where coal dust has been a
concern, Vilvang has had several inquiries about the lawsuit, albeit some are outside the scope of
the action. "People complain about noise, that their house is shaking, and I tell them there's
nothing we can do about that. They take this opportunity to make any complaints about the railways,
but this is about coal dust, period."
Vilvang will address a public meeting in Kamloops on June 24 at Desert Gardens at 7 p.m.
