Zillertalbahn Blown Away in Court

Jenbach - After his termination the former commercial director of the Zillertalbahn (ZVB) complained.
 
The Labor and Social Court proved him right.
 
Now the ZVB Supervisory Board is addressing this again.
 
On 7 Jul 2015, the commercial director of the Zillertalbahn, Andreas Lackner, was let go and he didn't understand the world anymore.
 
"I did not commit any offense," he repeatedly asserted.
 
He sued the company, now after several days at trial, the verdict of the Regional Court of Innsbruck has arrived.
 
"It is stated to the defendant that the dismissal without notice is not effective, and that the employment relationship between the parties continues beyond 7 Jul 2015," the court said at the beginning of its 69 page judgement.
 
ZVB board member Wolfgang Stöhr did not want to comment on this topic yesterday.
 
"An opinion will be given by the chairman of the Supervisory Board, Franz Hörl," he said.
 
And Hörl did not mince his words to the Tiroler Tageszeitung, "Our predecessors on the Supervisory Board had their reasons to unanimously disassociate themselves from the authorized signatory. Even the works council has agreed to this dismissal. We have important projects ahead of us in the coming years. This requires focusing on that work and setting the course."
 
Following the judgment it is now the task of the Supervisory Board to re-evaluate the situation at a meeting next Friday.
 
Hörl is completely open about that session, "It is quite possible that we will instruct the Board to appeal against this ruling. At the same time, however, we would also welcome any settlement negotiations."
 
When asked, the chairman of the Supervisory Board specified, "A comparison is being sought. Not at any price, but with the aim of finally closing this chapter. That solution, however, must be possible in terms of business conditions and should not reach astronomical heights."
 
Hörl said, "We are talking about remuneration, the amount of which is not comparable with a company such as ZVB, and the position of the authorized representative. The current board members know our position and are instructed to pay attention to their proportionality in salaries and fees."
 
Andreas Lackner is stisfied with the decision, "It has been clarified by the court that I did not behave worthy of termination. The charge of trustworthiness was completely out of thin air. In any case, the judgment also gives me the opportunity to take steps to restore my reputation. In particular, the allegation of lying to the Supervisory Board."
