CP Rail Spill Trial Set to Begin Today
Minneapolis Minnisota - A jury has been seated in Minneapolis to hear the first cases from a
January 2002 train derailment and chemical spill at Minot, N.D., to go to trial.
The jury was seated yesterday afternoon, said Fargo lawyer Mike Miller, who is representing two of the three plaintiffs. Opening
statements were to begin this morning.
"We'll finally get... some evidence presented to a jury," Miller said.
Six cases were settled out of court earlier, including one yesterday. The settlements included a wrongful death lawsuit brought by the
widow of John Grabinger, 38, who died while trying to escape the anhydrous ammonia cloud released by the CP Rail wreck.
Terms of those settlements have not been released. CP Rail has declined to discuss the lawsuits. The trial is expected to last three
weeks.
