DM&E Appeals Dismissal of Lawsuit
Former DM&E company president Kevin Schieffer.
Sioux Falls South Dakota USA - The Dakota, Minnesota & Eastern Railroad is appealing the
dismissal of its lawsuit seeking to keep former company president Kevin Schieffer from arbitrating a severance package.
A federal judge ruled in June that courts don't have jurisdiction and he granted Schieffer's request to dismiss the lawsuit. The railroad is appealing to the
8th U.S. Circuit Court of Appeals.
Schieffer left as DM&E's president after Canadian Pacific Railway bought the company. Earlier this year he demanded arbitration over what he said was a $4
million miscalculation in his severance package.
The DM&E said the demands were unreasonable and it sued him to force the dispute into federal court.
