CP Rail Criticized for Cutting Trees in Family's Backyard
Montreal Quebec - A Westmount family is upset after the Canadian Pacific Railway cut down two of their trees, and they're concerned
that the company will return to remove the remaining trees that line their property.
"CP just showed up unannounced. There was no notice, No conversation, no phone call, no letters, no nothing," said Alice Brais.
Pierre and Alice Brais have put a lot of work into landscaping their backyard and were shocked when they came home on Monday to find a CP crew in their
yard.
"They said they were from CP rail and I asked them what's your business doing here, and they said that the train driver couldn't see the signal lights
which are way down that way," said Pierre.
The Brais' backyard is more than 200 metres from the signal lights, and Pierre says while some branches hang over his fence, he does not know how CP decided to
chop down trees.
"From going on the tracks and looking at it, I cannot see how my trees obstruct the view of the signals. But they have not bothered to demonstrate what
analysis, what studies they have done to establish that," said Pierre.
CP said it is reviewing the situation.
"Railway property extends 50 feet on both sides of the track. However, there are situations where this does not apply. CP officials are currently looking
at this area to determine property lines and whether rail property is less than 50 feet," wrote the company in a statement.
The Brais family said the land used to belong to CP, but that the company sold the family six metres of land a decade ago.
"They sold us this land in 2005, trees and all," said Pierre.
"Nothing was said about the trees being something they want to cut down."
The family is now waiting for Thursday, when CP workers said they will return to chop down the remaining trees lining the fence.
